Revisión de la adecuación de multas por los impactos ambientales ocasionados por la deforestación en el Fundo Tamshiyacu, Loreto, Perú

Abstract

El presente trabajo de suficiencia profesional tiene como objetivo verificar la adecuación de la multa correspondiente a los impactos negativos en los servicios ecosistémicos, ocasionados por la deforestación en el fundo Tamshiyacu, Loreto-Perú, en el periodo 2013 – 2016. El enfoque general está orientado a revisar y actualizar los componentes y el método de estimación de la multa, sobre todo aquel asociado con el daño ambiental; la estimación se realizó a través de los métodos de precios de mercado y transferencia de beneficios. El análisis de la información permitió corroborar que los cálculos realizados por el OEFA y SERFOR tuvieron varias faltas de información cuando estas fueron realizadas. En el presente estudio, los resultados arrojaron una multa calculada mayor a la estimada por el OEFA en el año 2020; mostrando así, que pese a que en algunos casos se pueda ocasionar daños ambientales de grandes magnitudes, el individuo o entidad que lo ocasionó, no siempre será sancionado en la misma medida que el perjuicio que ocasionó. Es importante añadir finalmente que debido a la “tipificación de infracciones” existente, en la práctica la multa tiene, a la fecha, un monto máximo de 30,000 UIT, valor inferior a las multas que han sido antes referidas como producto de la valoración de daños a los servicios ecosistémicos.

The present professional sufficiency work aims to verify the adequacy of the fine corresponding to the negative impacts on ecosystem services, caused by deforestation in the Tamshiyacu farm, Loreto-Peru, in the period 2013 – 2016. The general approach is aimed at reviewing and updating the components and method of estimating the fine, especially that associated with environmental damage; the estimation was made through the methods of market prices and transfer of benefits. The analysis of the information corroborated that the calculations made by OEFA and SERFOR had several information gaps when they were made. In the present study, the results showed a calculated fine higher than that estimated by the OEFA in 2020; thus showing that although in some cases environmental damage of great magnitudes can be caused, the individual or entity that caused it, will not always be sanctioned to the same extent as the damage caused. Finally, it is important to add that due to the existing "classification of infractions", in practice the fine has, to date, a maximum amount of 30,000 UIT, a value lower than the fines that have been referred to above as a product of the valuation of damages to ecosystem services.
