Evaluación de la normativa peruana sobre la gestión del agua para la minería, con respecto a los lineamientos del ICMM

Abstract

Teniendo en cuenta la actual preocupación por la búsqueda de la sostenibilidad de las organizaciones gubernamentales y no gubernamentales, las empresas se han venido agrupando en organizaciones que desarrollen diferentes herramientas que permitan guiar a sus miembros hacia la sostenibilidad de sus proyectos. El Consejo Internacional de Minería y Metales (ICMM), es un ejemplo de ello. En este contexto, la autora viene trabajando para el proyecto minero Romina, el cual ha venido buscando obtener inversión para su construcción de parte de una de las empresas miembros del ICMM; es así como, para lograrlo, el proyecto debe de cumplir con los lineamientos de esta institución. En relación, con lo antes mencionado, la autora estuvo encargada de la sección ambiental. Del análisis comparativo realizado, se ha podido observar que en su mayoría existen similitudes entre los lineamientos en cuanto a los recursos hídricos del ICMM y la normativa nacional. Sin embargo, también se encontraron algunas diferencias, como el detalle que busca el ICMM, a nivel de estudios de factibilidad, en temas como aceptación social, institucionalidad, cambio climático, indicadores de sostenibilidad, en comparación a lo requerido por la normativa nacional en los mismos temas. Por otro lado, es importante mencionar que este trabajo de análisis servirá de referencia para futuros proyectos mineros peruanos que estén interesados en la inversión de empresas que estén asociadas al ICMM. En cuanto a las recomendaciones, sería importante que a futuro se pueda realizar una evaluación de la institucionalidad de la gestión de recursos hídricos a nivel local, para verificar que lo indicado en las normas tienen buenos resultados a nivel práctico. Así mismo, se recomienda que se realizar una evaluación económica – financiera de la aplicación de lo requerido en la Guía del ICMM para nuevos proyectos mineros, con la intención de verificar su rentabilidad.

Considering the current concern about the search for sustainability of governmental and nongovernmental organizations, companies have been grouping themselves into organizations that develop different tools that allow their members to be guided towards the sustainability of their projects. The International Council on Mining and Metals (ICMM) is an example of this. In this context, the author has been working for the Romina mining project, which has been seeking to obtain investment for its construction from one of the ICMM member companies; this is how, to achieve this, the project must comply with the guidelines of this institution. Considering the aforementioned, the author realized the environmental section. From the comparative analysis carried out, it has been observed that there are mostly similarities between the guidelines regarding water resources of the ICMM and the national regulations. However, some differences were also found, such as the detail sought by the ICMM, at the level of feasibility studies, in topics such as social acceptance, institutionality, climate change, sustainability indicators, in comparison to what is required by national regulations in the same topics. On the other hand, it is important to mention that this analysis work will serve as a reference for future Peruvian mining projects that are interested in the investment of companies that are associated with the ICMM. Regarding the recommendations, it would be important that in the future an evaluation of the institutionality of water resources management at the local level could be carried out, to verify that what is indicated in the standards have good results at a practical level. Likewise, it is recommended that an economic-financial evaluation be carried out of the application of what is required in the ICMM Guide for new mining projects, with the intention of verifying their profitability.
