Abstract
El presente trabajo de suficiencia profesional describe y analiza la gestión de tramitología ambiental requerida para proyectos de exploración minera en el Perú. El estudio tiene como objetivo principal desarrollar una guía que sistematice los procedimientos para la ejecución de proyectos de exploración minera en el Perú, considerando la normativa vigente. A través de una revisión de los trámites requeridos y de la experiencia laboral se busca optimizar la planificación del titular minero, considerando la obtención de permisos como el Instrumento de Gestión Ambiental, la Autorización de Inicio de Actividades, entre otros. Asimismo, se han analizado los cambios normativos promovidos por el Ministerio de Energía y Minas que impactan estos procesos desde el Primer Reglamento Ambiental para las Actividades de Exploración Minera en 2008 y se evalúan casos prácticos de Ficha Técnica Ambiental, Declaración de Impacto Ambiental y Estudios de Impacto Ambiental semidetallado ingresados al SEAL entre 2021 al 2022, para comparar tiempos de evaluación teóricos y reales. El trabajo concluye que el Ministerio de Energía y Minas ha impulsado mejoras significativas en el marco normativo, sin embargo, debe de agilizarse el proceso de evaluación del Instrumento de Gestión Ambiental, reduciendo así la incertidumbre del tiempo de evaluación. Respecto a los resultados del tiempo de evaluación para FTA es de 13 días hábiles, para DIA de 197 días hábiles y para EIAsd de 342 días hábiles. En comparación con el tiempo de evaluación normado, sólo la FTA cumple con el tiempo establecido. Asimismo, es importante agilizar y dinamizar el proceso mediante la presentación de la información en una plataforma única, mejorar la calidad de la información presentada por el titular minero, elaborada en conjunto con la consultora ambiental. Estos esfuerzos, en conjunto, podrían generar como resultado que Perú se posicione como un destino más atractivo para la inversión minera.
This professional proficiency report describes and analyzes the management of environmental permitting required for mining exploration projects in Peru. The main objective of the study is to develop a guide that systematizes the procedures for executing mining exploration projects in Peru, in accordance with current regulations. Through a review of the required permits and professional experience, the aim is to optimize the planning process for mining titleholders, taking into account the acquisition of permits such as the Environmental Management Instrument, the Authorization to Start Activities, among others. In addition, regulatory changes promoted by the Ministry of Energy and Mines that have impacted these processes since the first Environmental Regulation for Mining Exploration Activities in 2008 are analyzed. Practical cases of Environmental Technical Files (FTA), Environmental Impact Declarations (DIA), and Semi-detailed Environmental Impact Studies (EIAsd) submitted to the SEAL between 2021 and 2022 are evaluated to compare theoretical and actual evaluation times. The study concludes that the Ministry of Energy and Mines has promoted significant improvements in the regulatory framework; however, the evaluation process for the Environmental Management Instrument must be streamlined to reduce uncertainty regarding evaluation time. Regarding evaluation time results: FTAs take 13 business days, DIAs take 197 business days, and EIAsd take 342 business days. Compared to the regulated evaluation times, only the FTA meets the established timeframe. Furthermore, it is important to streamline and enhance the process by presenting information through a unified platform, and by improving the quality of the information submitted by the mining titleholder in collaboration with the environmental consultant. These combined efforts could position Peru as a more attractive destination for mining investment.
