Abstract
Toda actividad que se desarrolle independientemente del rubro o la cantidad de.mano de obra va a requerir, dentro del marco normativo de la la Ley.Nº 28611 - Ley.General del Ambiente (LGA) de Perú, un Instrumento de Gestión.Ambiental (IGA) que de acuerdo con sus propios principios, lo ideal sería que fuera uno preventivo con el objetivo de evitar la contaminación ambiental. Sin embargo; por cambios en la normativa y en la competencia en la evaluación, fiscalización y sanción por no poseer IGA preventivo los sectores productivos optaron por emitir dispositivos legales que faculten la “Adecuación Ambiental”. Es de esta forma que se normaron IGA´s correctivos. En el presente Trabajo de Suficiencia Profesional (TSP) se ha analizado las fortalezas y debilidades de los IGA´s correctivos de los sectores: Vivienda, Manufactura y Comercio Interior y Energía y Minas. Estos IGA´s en la mayoría de los sectores se les denominó Plan ambiental Detallado (PAD). De igual forma, se identificaron incoherencias en los términos utilizados en los dispositivos legales, como la expresión “adecuación ambiental por única vez”, ya que posteriormente se emitieron otros dispositivos legales que permiten su prórroga, lo cual evidencia una contradicción normativa. Sin embargo, se destaca la participación de entes fiscalizadores dentro del proceso de evaluación. Asimismo, también se comprobó en forma y normatividad el cumplimiento del PAD de la Estación de Servicio (EESS) Principal y se detectaron algunas observaciones y una no conformidad dentro de lo normado en la Resolución.Ministerial Nº.113-2019-MEM/DM. El análisis incluyó la complementación con lo dispuesto en los deberes y principios de la Ley General de Ambiente (LGA).

Likewise, inconsistencies were detected in the terms they used within their preliminary provisions such as those of “one-time” environmental adaptation, which become evident when issuing other legal devices that authorize the extension. However, the participation of supervisory entities within the evaluation process stands out. Likewise, compliance with the PAD of the Main Service Station (EESS) was also verified in form and regulations and some observations and non-conformity were detected within the provisions of Ministerial Resolution No. 113-2019-MEM/DM. The analysis included the incorporation of the duties and principles established in the General Environmental Law (GEL).
